O presente trabalho pretende uma comparação entre o Artificial Intelligence Act, cujo texto foi proposto pela Comissão Europeia, órgão competente da União Europeia, em 2021 e o Projeto de Lei n° 2.883/23, proposto em maio de 2023 pelo Senador Rodrigo Pacheco (PSD/MG), fortemente inspirado no projeto europeu porém inserido num ordenamento jurídico completamente distinto e numa realidade socioeconômica também diferente da presente na Europa. O projeto europeu traz uma abordagem de regulamentações diferenciadas para cada uso de sistemas de inteligência artificial baseadas no grau de risco oferecido por cada hipótese, dividindo toda a gama de possibilidades em quatro categorias de risco, atribuindo restrições e normatizações distintas para cada um deles. O projeto brasileiro segue nessa toada, apresentando três graus de risco com normatizações distintas, com clara influência do projeto europeu mas adaptando as disposições à realidade brasileira. Foram comparadas as disposições de cada um dos projetos, bem como consideradas e apresentadas análises críticas de cada um dos projetos legislativos, com a finalidade de esclarecer o sistema que prevê cada um deles e destacar pontos onde o projeto europeu inspirou o brasileiro, mas principalmente onde o último inovou sobre seu antecessor.
